Terms of Service
Version 1.0 — Effective July 10, 2026
By using Stencled ("the platform"), you agree to these Terms of Service. Please read them carefully. If you do not agree, do not use the platform.
Who can use Stencled
Stencled is a business management platform for independent tattoo artists and piercers. Access is currently by invitation only.
By creating an artist account, you represent that you are a professional artist or piercer using the platform in connection with your business, that you are at least 18 years of age, and that you are operating in compliance with all applicable laws in your jurisdiction. Clients submitting booking requests through the platform must also be at least 18 years of age.
Professional attestation
During account setup, each artist is required to confirm the following under their full legal name:
- That they are a licensed professional in compliance with all applicable laws and regulations in their jurisdiction
- That they are at least 18 years of age
- That they have read and agree to these Terms of Service
Stencled relies on this declaration in good faith. Providing false information — including falsely representing your licensing status — is a material breach of these terms and may result in immediate account termination. Stencled bears no liability for harm resulting from an artist's misrepresentation of their professional credentials.
Your account
You are responsible for maintaining the security of your account. Stencled uses passwordless authentication (magic links) — keep your email account secure. Notify us immediately at hello@stencled.com if you believe your account has been compromised.
You may not share your account or use it on behalf of another artist without explicit permission. Each artist is entitled to one account under the free plan.
Artist responsibilities
As an artist using Stencled, you agree to:
- Provide accurate information in your profile and booking forms
- Obtain any necessary consents from your clients before collecting their personal information through the platform
- Comply with applicable laws regarding data collection, tattoo and piercing practice, and business operations in your jurisdiction
- Obtain appropriate consent from clients before publishing photographs or images of their tattoos, where required by applicable law in your jurisdiction
- Not use the platform to send spam or unsolicited communications
- Not upload content that infringes on third-party intellectual property rights
Content and intellectual property
You retain full ownership of all content you upload to Stencled — portfolio images, flash designs, profile copy, and all other materials. By uploading content, you grant Stencled a limited, non-exclusive license to store, display, and deliver that content solely for the purpose of operating the platform and your microsite.
Tattoo designs created by artists are the intellectual property of the artist. Artists are responsible for ensuring they have the right to upload and display any content they publish on the platform, including reference images provided by clients.
Stencled's branding, platform design, and codebase are our intellectual property. You may not copy, reproduce, or create derivative works from them.
Client data
When clients submit booking requests through your microsite, they are submitting information to you as the artist. You are the data controller for client submissions. Stencled processes this data on your behalf as a data processor.
You are responsible for complying with applicable privacy laws regarding client data you collect through the platform, including obtaining appropriate consents.
Payments and billing
Stencled charges artists a flat monthly or annual subscription fee for paid plans. Billing is processed by Stripe. By subscribing to a paid plan, you authorize Stencled to charge your payment method on a recurring basis.
We never take a percentage of your earnings. Stencled does not process payments between artists and their clients. Any payments between artists and clients are entirely outside the platform.
Subscriptions can be cancelled at any time. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial periods.
Platform role and limitation of liability
Stencled is a technology platform. We are not an employer, booking agency, or service provider. We do not perform, supervise, or guarantee any tattooing or piercing services. The relationship between an artist and their clients is entirely independent of Stencled.
We aim to keep Stencled available and reliable, but we don't guarantee uninterrupted access. The platform is provided "as is." To the extent permitted by law, Stencled is not liable for any business losses resulting from platform downtime, bugs, data loss, or the acts or omissions of artists using the platform.
We back up data regularly but recommend maintaining your own records of critical client information.
Acceptable use
You may not use Stencled to:
- Conduct any illegal activity
- Create accounts for artists who are not licensed professionals
- Upload malicious code or attempt to compromise the platform's security
- Harvest data from other artists' public microsites beyond normal browsing
- Misrepresent your identity or credentials
- Facilitate bookings with clients who are under 18 years of age
- Use the platform in a way that degrades the experience for other users
Termination
You may delete your account at any time from your dashboard settings. Upon deletion, your data is removed within 30 days per our Privacy Policy.
We reserve the right to suspend or terminate accounts that violate these terms, including accounts where the artist's professional attestation is found to be false or misleading, with or without notice depending on the severity of the violation.
Changes to these terms
We may update these terms from time to time. We'll notify active users of material changes via email at least 14 days before they take effect. When material changes are made, active artists will be asked to review and re-confirm their agreement before continuing to use the platform. Continued use after that date constitutes acceptance of the updated terms.
Each version of these terms is archived and identified by its effective date. The version you agreed to at account creation is recorded in your account.
Governing law
These terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
